PRIVACY POLICY
This Privacy Policy applies to Bodren Academy Pty Ltd t/a Ministry of Sound Academy (“MOSA”). In this Privacy Policy the terms “we”, “us” and “our” are a reference to MOSA.
1. About MOSA and this Privacy Policy
MOSA is committed to the protection of your personal information. This Privacy Policy is based on the “National Privacy Principles” (“NPPs”) set out in the Privacy Act 1988 (Cth) (“Privacy Act”). It outlines how we collect personal and sensitive information, as defined in the Privacy Act, and how we maintain, use, disclose and secure that information and destroy information that is no longer needed. It also provides some detail about your privacy rights along with our general rights and obligations under the Privacy Act.
Keeping your information secure, and using it only as you would want us to, is a top priority for all of us at MOSA.
2. Personal Information and Sensitive Information
Personal Information is defined in the Privacy Act to mean information or an opinion (including information or an opinion forming part of a database), whether true or not and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion. It includes “sensitive information”.
Sensitive Information is defined in the Privacy Act to mean information or an opinion about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices or criminal record, that is personal information, or, health or genetic information about an individual.
3. What Personal Information does MOSA Collect?
MOSA only collects personal information that is necessary to assist us in providing our services.
The type of personal information we collect from you will depend on the circumstances of collection and on the type of service you request from us. For example, when you wish to enrol or learn about courses available at MOSA, we may collect details such as your name, address, date of birth, emergency contact details, telephone numbers, email addresses, and transport facilities (if any). As we are required under the Privacy Act to obtain your consent to the collection of sensitive information, we will assume you have consented to the collection of all information which is provided to us for use in accordance with this Privacy Policy.
All information collected is required and used for our business purposes only.
4. How does MOSA collect Personal Information?
In most situations the information we collect about you is provided to us directly by you, when registering your details with us.
MOSA may collect personal information about you in a number of ways, including, but not limited to:
(a) directly from you via the online course booking system where such system will collect your full name and email address and potentially mobile number.
(b) directly from you via our website when you enter your details into our waiting list in the event that a course is full or a specific course has not been scheduled at the time; or
© directly from you, either in person, by phone, facsimile or electronically.
5. How does MOSA use Personal Information?
Unless you object, MOSA may use your personal information to:
(a) organise and process your course requirements;
(b) facilitate your participation in the courses and payments of required fees;
© compile class lists;
(d) conduct marketing activities and to conduct market research;
(e) contact you;
(f) fulfil administrative functions associated with your application requirement;
(g) effectively manage your course and teaching arrangements; and
(l) contact family members in case of an emergency.
We will only use your personal or sensitive information for the purpose for which it was provided or a related secondary purpose, unless you agree otherwise or the use or disclosure is permitted under the Privacy Act.
6. Opt-Out
You may remove yourself from future messages, news, promotional materials and the like by following the instructions found within the sent message. After the Opt-Out request is processed, a final message will be sent to you confirming removal of your address.

7. Rights to Disclose Personal Information
In using personal information, we may need to disclose your personal information from time to time to various organisations and/or parties for the purposes for which the information was collected or for related purposes, for example to provide you with a service that you requested or to help us to provide and market our services to you.
For example, we may disclose your personal information to our contractors to whom we contract out certain services, data processing companies, information technology services providers, marketing service providers, market research agents, business partners and affiliate companies of MOSA.
For all other purposes, your consent is generally required prior to disclosure of personal information, however we may still use or disclose that information if:
(a) we subsequently notify you of the intended use or disclosure and you do not object to that use or disclosure;
(b) we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security in the performance of their functions;
© we have reason to suspect that unlawful activity has been, is being or may be engaged in, and we use or disclose the personal information as a necessary part of our investigation of the matter or in reporting our concerns to relevant persons or authorities;
(d) it will prevent or lessen a serious and imminent threat to somebody’s life, health or safety or a serious threat to public health or public safety; or
(e) we are required by law to disclose the information.
Personal information which we collect may be aggregated for analysis but in such circumstances we would ensure that individuals remain anonymous.
If you request us not to use personal information in a particular manner or at all, we will adopt all reasonable measures to observe your request.
8. Protection and Security of Personal Information
We take reasonable steps to protect all personal information we collect or hold about you from misuse and loss, and from unauthorised access, modification and disclosure to the best of our ability. We have physical, electronic and procedural safeguards to protect your information that is held by us, and this includes among other things, we prevent other customers from accessing your information, preventing employees from accessing information they have no need to access, by employing industry standard techniques, such as virus scanning tools and by practising a clean desk policy and by providing secure storage for physical records.
We utilise “cookies” which enable us to monitor traffic patterns and to serve you more efficiently if you revisit the site. A cookie does not identify you personally but it does identify your computer. You can set your browser to notify you when you receive a cookie and this will provide you with an opportunity to either accept or reject it in each instance.
We will not sell or otherwise provide your personal information to a third party, or make any other use of your personal information, for any purpose which is not incidental to your use of this Website. For the removal of doubt, personal information will not be used for any purpose which a reasonable person in your position would not expect.
MOSA uses secure methods to destroy or de-identify any personal information as soon as the law permits, provided the information is no longer needed by us for any purpose. MOSA will review security arrangements from time to time as is deemed appropriate.
9. Online Links to Third Party Websites
MOSA may establish relationships with business partners that allow users of the Website to access websites operated by these partners through the use of a hyperlink.
MOSA is not responsible for the content or practices of websites operated by third parties that are linked to the Website. These links are for the User’s convenience only. Links to third party websites do not constitute sponsorship, endorsement or approval by us of the content, policy or practise of those third party websites. Once you have left the Website via such a hyperlink, you should check the applicable privacy policy of the third party website.
10. Updating and Correction of Information
We take reasonable steps to ensure that all personal information we hold about customers is accurate, complete and up to date. You should therefore promptly notify us if there are any changes to the personal information we hold about you.
You may ask us at any time to correct personal information held by us about you, which you believe is incorrect or out of date. We will deal with such requests within a reasonable time.
If we disagree as to the accuracy of the information, you may request that we attach a statement to that information noting that you consider it to be inaccurate, incomplete or out of date.
11. Access to Information
Individuals are entitled to request access to any personal information relating to them that has previously been supplied to us. They are entitled to edit or delete such information unless we are required by law to retain it.
We will process requests for access to personal information within a reasonable time, usually 14 days for a straightforward request or 30 days if it is more complicated. More time may be needed, depending on the nature of the request. Appropriate identification of the individual concerned will be confirmed before access is provided.
There is no fee charged for requesting access to your personal information, however we may charge you for the reasonable cost of processing your request.
In certain circumstances, we are permitted by the Privacy Act to deny such requests for access, or to limit the access we provide. If we refuse or limit your access to your personal information, we will inform you of the reason why.
